By accessing or using ReadySetHalloween, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Service Description

ReadySetHalloween is an AI-powered photo transformation service that applies Halloween-themed artistic styles to user-uploaded photos. The Service provides:

• Free Preview Generation: Watermarked preview of your photo in selected Halloween style
• Paid Downloads: High-resolution, unwatermarked downloads in multiple formats ($2.99-$5.99)
• 16 Halloween Styles: Classic horror, modern/fun, and artistic transformation options
• Multiple Formats: Original, square, story, landscape, and PDF formats (bundle-dependent)

3. Prohibited Content Policy

We use automated content moderation (AWS Rekognition) to detect and block prohibited content. The following types of content are strictly forbidden and will result in immediate upload rejection and potential account termination:

Enforcement: Uploads are automatically scanned before storage. Prohibited content will be rejected with a generic error message. Repeated violations may result in IP blocking or legal action.

4. User Responsibilities

By using the Service, you represent and warrant that:

• Age Requirement: You are at least 13 years of age
• Legal Capacity: You have the legal capacity to enter into this agreement
• Accurate Information: All information you provide is accurate and truthful
• Lawful Use: You will use the Service only for lawful purposes
• Content Rights: You own or have permission to use all photos you upload
• Compliance: You will comply with all applicable laws and these Terms

5. Content Moderation & Enforcement

We employ automated content moderation to protect our Service and community:

• Automated Scanning: All uploads are scanned using AWS Rekognition before storage
• Confidence Threshold: Content flagged with 80%+ confidence is automatically blocked
• Output Filtering: AI-generated outputs are also filtered by fal.ai safety systems
• No Human Review: Rejected uploads are not manually reviewed to protect our team
• Right to Refuse Service: We reserve the right to refuse service to anyone for any reason
• Account Termination: Repeated violations will result in permanent IP blocking

6. Rate Limiting & Usage Restrictions

To prevent abuse and ensure fair access, the following limits apply:

Users who attempt to circumvent rate limits through automation, VPNs, or other means will be permanently blocked.

7. Payment Terms

Paid downloads are processed through Stripe Hosted Checkout:

• Pricing: $2.99 (Spooky Selfie), $3.99 (Spooky Social Pack), $5.99 (Complete Spooky Suite)
• Upsells: Animated ($1.99), Print-Ready ($1.49), Morning Delivery ($0.99) - optional add-ons
• Payment Processing: All payments processed securely by Stripe (we never see your card details)
• Currency: All prices in USD
• Taxes: Prices do not include applicable sales tax (calculated at checkout)

8. Data Retention & Deletion

Your content is automatically deleted according to our data retention schedule:

• Uploaded Photos: Deleted after 1 hour
• Generated Previews: Deleted after 24 hours
• Download Links: Expire after 24 hours (content remains downloadable during this period)
• Order Records: Deleted after 7 days
• Email Addresses: Retained for 7 days for order fulfillment

9. Intellectual Property Rights

9.1 Your Content

You retain all ownership rights to photos you upload. By uploading content, you grant us a limited, temporary license to:

• Store your photo temporarily in AWS S3 (1 hour)
• Process your photo through fal.ai AI generation systems
• Generate Halloween-styled transformations
• Deliver downloads to your email address

This license terminates when your content is automatically deleted (1-24 hours depending on content type).

9.2 Generated Content

AI-generated Halloween transformations are owned by you upon purchase. You may use generated content for:

• Personal social media sharing
• Printed materials for personal use
• Halloween costumes, decorations, or party invitations

You may not resell, redistribute, or commercially license generated content without explicit written permission.

9.3 Our Property

The ReadySetHalloween name, logo, service design, and all underlying technology are owned by l33t LLC. You may not copy, modify, or create derivative works based on our Service.

10. Disclaimers & Limitation of Liability

Some jurisdictions do not allow limitations on warranties or liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless l33t LLC from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your infringement of third-party rights (copyright, trademark, privacy, etc.)
• Content you upload to the Service
• Your misuse of generated content

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms or our Prohibited Content Policy
• Fraudulent activity or payment disputes
• Attempts to circumvent rate limits or abuse the Service
• Harmful behavior toward our team or other users
• Legal requirements or court orders

Upon termination, your right to use the Service ceases immediately. All data will be deleted according to our retention schedule.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated via email (if we have your email) or prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules. You waive the right to participate in class action lawsuits or class-wide arbitration.

If arbitration is not enforceable, disputes shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and l33t LLC regarding the Service and supersede all prior agreements and understandings.

17. DMCA Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement.

Filing a DMCA Takedown Notice

If you believe your copyrighted work has been uploaded to our Service without authorization, please send a DMCA takedown notice to our designated Copyright Agent with the following information:

Counter-Notice

If you believe your content was removed in error, you may file a counter-notice containing:

• Your physical or electronic signature
• Identification of the removed material and its prior location
• A statement under penalty of perjury that the material was removed by mistake or misidentification
• Your contact information and consent to jurisdiction in Delaware federal court

Note: Given our automatic 1-hour upload deletion policy, most copyright issues are resolved automatically. However, purchased downloads are available for 24 hours and may require manual DMCA takedown.
